Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and related services offered by Alert LAC 911 (“we,” “us,” or “our”) (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
This is a general template for informational purposes only and does not constitute legal advice. You should have qualified counsel review and adapt it for your organization.
1. Eligibility and accounts
You must be able to form a binding contract in your jurisdiction to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
2. Description of the Services
The Services may provide incident awareness, maps, weather-related information, notifications, and other features. Information may be incomplete, delayed, or inaccurate. The Services aggregate or display data from third-party and public sources; we do not control those sources.
Not an emergency service. The Services are not a substitute for calling 911 or your local emergency number, and are not an official dispatch or government system. For emergencies, contact appropriate authorities immediately.
3. Subscriptions, fees, and billing
Some features may require a paid subscription or add-on. Fees, renewal terms, and cancellation rights are presented at checkout and in your billing portal. Unless stated otherwise, subscriptions renew automatically until canceled. Taxes may apply. We may change pricing with reasonable notice as required by law.
4. Acceptable use
You agree not to:
- Use the Services in violation of law or third-party rights;
- Attempt to gain unauthorized access to systems, data, or accounts;
- Interfere with or disrupt the Services or servers or networks connected to the Services;
- Scrape, harvest, or automate access to the Services in a way that overloads or circumvents intended use, except as expressly permitted by us in writing;
- Reverse engineer, decompile, or disassemble any part of the Services except where prohibited by law;
- Use the Services to stalk, harass, or harm others; or
- Misrepresent your identity or affiliation.
We may suspend or terminate access for conduct that we reasonably believe violates these Terms or harms the Services or other users.
5. User content
If you submit content to the Services (for example, messages or files), you grant us a non-exclusive license to use, host, store, reproduce, and display that content as needed to operate and improve the Services. You represent that you have the rights to grant this license and that your content does not violate law or third-party rights.
6. Intellectual property
The Services, including software, design, text, graphics, and trademarks, are owned by us or our licensors and are protected by intellectual property laws. Except for the limited right to use the Services in accordance with these Terms, no rights are granted to you.
7. Third-party services and links
The Services may integrate with or link to third-party websites, maps, data providers, or tools. Those services are governed by their own terms and privacy policies. We are not responsible for third-party content or practices.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATION TO US.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Indemnity
You will defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your content, or your violation of these Terms or applicable law.
11. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if we are required to do so by law, or if we discontinue the Services (with reasonable notice where practicable). Provisions that by their nature should survive termination will survive.
12. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles, except where preempted by U.S. federal law. You agree that the state and federal courts located in Los Angeles County, California have exclusive jurisdiction over disputes arising from these Terms or the Services, subject to any mandatory consumer protections in your jurisdiction.
13. Changes to these Terms
We may modify these Terms from time to time. We will post the updated Terms on this page and update the effective date. If a change is material, we will provide additional notice as required by law. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
